Fourth Defense Verdict in an Engle Case in Two Weeks for Philip Morris USA
RICHMOND, Va., Oct 15, 2010 --

Juries in both Hillsborough County and Miami-Dade County today decided in favor of Philip Morris USA in Engle cases. The verdicts today mark the fourth time in two weeks that Florida juries in an Engle case have found for Philip Morris USA.

"We believe that both juries today reached the correct result," said Murray Garnick, Altria Client Services senior vice president and associate general counsel, speaking on behalf of Philip Morris USA. "This string of recent verdicts for the defense shows that Philip Morris USA has powerful defenses in these cases even when trial courts apply unfair procedures that do not require plaintiffs to prove their claims."

"In all these cases, the trial courts violated Florida law and due process by allowing the plaintiffs to rely on general findings from a previous jury with no connection to the specific circumstances of these cases," Garnick added.

The verdicts came in trials of so-called Engle progeny cases following a 2006 Florida Supreme Court decision that decertified a class action but allowed former class action members to file individual lawsuits and rely on general findings from the first class action. Recently, the 11th U.S. Circuit Court of Appeals severely restricted the ability of plaintiffs in the federal cases to use findings from the prior Engle jury to meet their burden of proof at trial. Neither the plaintiffs here nor any of the other plaintiffs in state courts have complied with the requirements set forth by this ruling.

Last week, both a Duval County jury and a Manatee County jury returned verdicts for Philip Morris USA in other Engle cases (Warrick and Willis).

Today's verdicts were in Campbell v. Philip Morris USA and RJ Reynolds (Hillsborough County) and Frazier v. Philip Morris USA and RJ Reynolds (Miami-Dade County).

They found her only 10% at fault for choosing to start smoking when she was 20. Cindy Naugle, now 60, smoked for 25 years.

Philip Morris said it will appeal, and was quite critical of the trial judge in its statement. "Today's verdict was the result of numerous erroneous rulings by the trial judge that allowed the jury to hear extensive evidence totally unrelated to the individual smoker, Lucinda Naugle," Murray Garnick, the general counsel of Philip Morris's parent company, said. "We believe that the punitive damages award is grossly excessive and a clear violation of constitutional and state law."

While these sorts of huge verdict and settlements seem like news out of the late 1990's, big tobacco companies still face court battles relating to their advertising and allegedly undisclosed smoking risks.

Stevia is a genus of about 240 species of herbs and shrubs in the sunflower family (Asteraceae), native to subtropical and tropical regions from western North America to South America. The species Stevia rebaudiana, commonly known as sweetleaf, sweet leaf, sugarleaf, or simply stevia, is widely grown for its sweet leaves. As a sweetener and sugar substitute, stevia's taste has a slower onset and longer duration than that of sugar, although some of its extracts may have a bitter or licorice-like aftertaste at high concentrations.

Medical research has also shown possible benefits of stevia in treating obesity and high blood pressure. The availability of stevia varies from country to country. In a few countries, it has been available as a sweetener for decades or centuries; for example, stevia is widely used as a sweetener in Japan where it has been available for decades. In some countries, stevia is restricted or banned. In other countries, health concerns and political controversies have limited its availability; for example, the United States banned stevia in the early 1990s unless labeled as a supplement, but in 2008 approved rebaudioside-A extract as a food additive. Horner of the National Institute of Neurological Disorders and Stroke in Bethesa, Md., both depict a roughly two fold risk of ALS development for U.S. veterans who were actively deployed in the Persian Gulf between August 2, 1990, and July 31, 1991, when compared with nondeployed U.S. military personnel."

"With deployed troops developing ALS more frequently and, maybe more importantly, much earlier in life than average, the two studies raise the question of whether an environmental factor could have triggered an early onset of the disease."

James Bowen, M.D. experienced terrible Lou Gehrigs symptoms and was being progressively destroyed, but as an MD and biochemist his research revealed that these symptoms are frequently associated with aspartame poisoning. He discontinued aspartame/NutraSweet/Equal and recovered most of his abilities and he believes many Desert Storm victims are similar aspartame victims, and if they discontinue this recognized neurotoxin in time they may well recover. Dr Bowen describes aspartame poisoning as minute doses of nerve gas that eradicates brain and nerve function. Dr. Russell Blaylock says in Health & Nutrition Secrets To Save Your Life: "In the case of diet drinks in aluminum cans, the very toxic brain aluminum fluoride compound co-exists with multiple toxins found in aspartame, thus creating the most powerful government approved toxic soup imaginable."

Arthur Hull Hayes, Jr. received an M.D. from Cornell in 1964. Hayes served a two-year stint in the Army's Chemical Weapons division under President Richard Nixon.

In 1981, after over 15 years of FDA disapproval of aspartame, G.D. Searle CEO Donald Rumsfeld, in a Searle sales meeting, vowed to "call in his markers" to get aspartame approved. Twenty days later, Ronald Reagan was sworn in as 40th President of the United States, appointing Rumsfeld as Special Envoy to the Middle East and Arthur Hull Hayes Jr. - a friend of Rumsfeld's - to FDA commissioner.

On January 21, 1981, the day after Ronald Reagan's inauguration, Searle re-applied to the FDA for approval to use aspartame in food sweetener. Reagan's new FDA commissioner, Arthur Hayes, appointed a 5-person Scientific Commission to review the board of inquiry's decision.

It soon became clear that the panel would uphold the ban by a 3-2 decision, but Hayes then installed a sixth member on the commission, and the vote became deadlocked. He then personally broke the tie in aspartame's favor. Hayes later left the FDA under allegations of impropriety, served briefly as Provost at New York Medical College, and then took a position with Burson-Marsteller, the chief public relations firm for both Monsanto and GD Searle. Since that time he has never spoken publicly about aspartame (Monsanto bought G.D. Searle in 1984 and the aspartame business become Monsanto subsidiary NutraSweet Co).

Burson-Marsteller also handled Johnson & Johnson's Tylenol crisis publicity campaign.

October 18, 2010 - Fort Washington, PA – McNeil Consumer Healthcare, Division of McNEIL-PPC, Inc., is recalling one product lot of TYLENOL® 8 Hour caplets 50 count bottles to the retail level. McNeil is taking this action following a small number of complaints of a musty or moldy odor. The uncharacteristic odor is thought to be caused by the presence of trace amounts of a chemical called 2,4,6-tribromoanisole. This voluntary action is being taken as a precaution and the risk of adverse medical events is remote. To date, observed events reported to McNeil for this lot were temporary and non-serious.

The product lot number for the recalled product can be found on the side of the bottle label.

During the initial investigations, a man named James W. Lewis sent a letter to Johnson & Johnson demanding $1 million to stop the cyanide-induced murders. Police were unable to link him with the crimes, as he and his wife were living in New York City at the time. He was convicted of extortion, served 13 years of a 20-year sentence, and was released in 1995 on parole. WCVB Channel 5 of Boston reported that court documents, released in early 2009, "show Department of Justice investigators concluded suspect James W. Lewis, who now lives in Cambridge, Massachusetts, was responsible for the poisonings, despite the fact that they did not have enough evidence to charge him." Lewis continues to deny responsibility for the poisonings.[4][5]

A second man, Roger Arnold, was investigated and cleared of the killings; however, the media attention caused him to have a nervous breakdown, and he blamed a bar owner, Marty Sinclair, for the police investigation of him. In the summer of 1983, he shot and killed John Stanisha, whom he mistook for Sinclair, but who was, in fact, an innocent man who did not know Arnold.[6] Arnold was convicted in January 1984 and served 15 years of a 30-year sentence for second degree murder. He died in June 2008.

Laurie Dann, who poisoned and shot victims in a May 1988 rampage in and around Winnetka, Illinois, was briefly considered as a suspect, but no direct connection was found.[7]

Xylitol is a five-carbon sugar alcohol, a natural carbohydrate which occurs freely in certain plant parts (for example, in fruits, and also in products made of them) and in the metabolism of humans (1). The definitive characterization and purification of xylitol to polarographic purity was accomplished already in the 1930's. The first successful crystallization of xylitol, after reduction of purified D-xylose, took place during the second world war. This product was not, however, a stable form of xylitol. A stable, crystalline form was obtained slightly thereafter.

I guess along the way I should have recognized the symptons....... There was Tyler's birday several years ago when I had a horrible horrible chest pain and my daughter took me to the hospital. She was mad at me as I messed up her son's birthday. Don't get me wrong, I could have understood that if I was a whiner. I could have understood that if I were a hypochondriac BUT I am not. I usually will simply get thru whatever and go on but this one time I had her help me in my time of crisis.

My son-in-law is the same. My granddaughter was bitten by a dog and afraid to tell her dad. She made the mistake of telling her brother and he told their dad and sure enough HE WAS MAD as hell. She came to me trying to hide from him and he came into my room and yelled and screamed and hollered at her. I was dumbfounded.

I don't know why I was dumbfounded as this had been going on for years and years but I hadn't lived with them all those 20 something years.

When I moved in with my daughter I started noticing strange things and it got to me. My youngest grandson would get up and stomp out of the room if he didn't like the food served to him and they would sit there. OMG.

Just recently I've been having chest pains again and I don't feel I can even talk to any of them. It is crazy.

I wish I could leave and live alone again but that isn't going to happen with the situation the way it is. I moved in with my son-in-law because of a HUGE disagreement with my daughter and it doesn't seem that is ever going to change. She now lives with someone who is very similar to her ex. hmmmmmmmmm

My youngest daughter is much the same and sure enough her husband is too. I really didn't recognize any of this until just recently. I didn't know the word narcissist but it surely fits the bill for my whole family.

I don't think my daughter had it until she married my son-in-law and I think that is when it started. He put her down constantly and never gave her any compliments. She stayed in the marriage because of all the kids and I hope it's not too late for her. In her youth I saw her empathy and her love of others but to tell you the truth, I don't see it now.

I think she had to learn to be that way to survive. Not sure if any of you remember this but I've said it many times. My father, after getting cancer and going through chemo and all became the exact mirror image of my mother.

When my daughter and son-in-law still lived together he controlled all the money and when she asked for 5$ a week, he denied that. She went to work as an AVON rep and that gave her some hope.

A couple of months ago my granddaughter came to me and asked me if I had a few bucks as her dad was broke and they wanted to go out and get a soda. I told her I did as I had been collecting coins in the laundry room and had about 4 bucks. Soon after that my granddaughter let me know she was collecting all the coins. (HE didn't want me to have any money period.) Don't get me wrong, I don't think he even realizes he does it. On the other hand I told him I was moving out when I started receiving my Social Security. I told him this, not because I wanted to move out but I didn't want the head games he plays when he knows money is involved.

I think living the way my daughter did all those years knocked the living shit out of her and I think it may take a long time to get her self back, maybe never.

This last little episode with my heart kind of scared the hell out of me but then again, I guess it's truly in mygod'shands and that's just the way it is. After all, I moved in with my son-in-law for the sole purpose of doing myworks on the net and if it ends abruptly, then it was simply meant to be.

I wish all the time I lived with others (or at least around others) that do what I do but I don't know how to go about getting to that point. hmmmmmmm

I know that I do good stuffs here for the kids but on the other hand, I can't get through to my son-in-law to even buy the right foods. He's set in his ways and even before all this genetically engineered foods, he wouldn't budge. When I mention that he needs to buy good stuffs, he simply looks at me and says, "we all have to die sometimes" and goes about 'HIS' ways and told me straight up he won't change.

I don't understand but it is very real. I want to write to Alex Jones and tell him that if you are dealing with narcissists, they HAVE to control and even at the cost of life, they won't give it up.

My son-in-law lies continuously when he wants money. He told me not long ago that his axle on his suburban was broken. (IT WAS NOT.) He didn't fix it and he drives it all the time. After that he told me his transmission was going out and he never fixed that either.

I'm feeling a bit hopeless now as I don't know if I've ever had anyone love me. I know that both of my husbands loved me as much as they were capable but they were both narcissists too. I walked away both times but I didn't know what was up with either of them. I only know that they didn't know how to love and neither does my son-in-law, his kids, or my daughter. Matter of fact all three of my kids.

I'm feeling really hopeless and it is a very hard place to be. I'm not sure if what I do is enough to keep me alive when I don't get anything from it in my human form. I'm not even sure if I can go back now or if it's all said and done.

Recently my son-in-law's mother visited. WOW, was that an experience. She has the same temper and when things don't go her way all hell explodes. I told her straight up that she had some pretty big shoes to fill. BTW, she bought my son-in-law a Harley and I could be wrong about this but almost possitive she helped by my g'son one as well.

She bought and bought and bought but I noticed something really strange. It was almost always for the boys. She also says her daughter has a mental disorder but never her son. It's reallyh kinda strange if you ask me. But then again again, who am I.

My daughter would try and buy gifts for her husband and they were never right. They were too big, too little, too itchy. My daughter would even call her mother-in-law and ask her what size, what this and what that but never was it right.

I've tried to give things to my son-in-law and he never once accepted them.

hmmmmmm, when she was here, his mom hung pictures on the wall. One might ask what's the big deal??? The big deal is had it been anyone but his mother doing it he would have had a temper tantrum and probably broke them.

I've been in the car with him when he's pulled out in front of a diesel truck. It scared everybody in the car and his kids and wife were with us. It's all a matter of control.

Showing off with my oldes granddaughter when she was teeny tiny, he would throw her up in the air and she would almost hit the ceiling and my daughter didn't say a word.

I got her aside and told her if he did it once more in front of me I would call the cops. That did give her the courage to talk to him about it and he stopped.

When I broke my arm he told all of us that he had almost beaten the dog to death. He's put two of my grandkids into discociating with his treatment of animals. (I talked to him after he did it to his son and told him what he had done and he has since stopped.)

This isn't all about my kids though as I experienced it with my husband's as well.

My brother's best friend's mother and father-in-law and his little girl were killed in a car accident and I was very torn up over it and attended the triple funeral with my brother.

After all was sad and done, I was crying in bed and he looked at me and said, I thought you didn't get along with Paulette anymore. (It was Paulette's mom, dad and daughter.) We had been really close at one period in our lives as we were pregnant at the same time. We talked on the phone daily and we visited occasionaly.(Matter of fact, Rhonda was born on my birthday.

We had drifted apart after a time but we never had any kind of falling out. Did David not have any empathy at all? I don't think so.

I haven't been able to eat anything in the last 2 days and I haven't been sleeping. I slept a few hours this morning but the thought of doom hangs over my head and I can't seem to do anything about it. (I did take a lengthy bath this morning but all I could think of was the fluoride in the tub and how it was being absorbed into my body. OMG!!!)

Atrophy

Disuse atrophy of muscles (muscle atrophy) and bones, with loss of mass and strength, can occur after prolonged immobility, such as extended bedrest, or having a body part in a cast (living in darkness for the eye, bedridden for the legs etc.). This type of atrophy can usually be reversed with exercise unless severe. Astronauts in microgravity must exercise regularly to minimize atrophy of their limb muscles.

There are many diseases and conditions which cause atrophy of muscle mass. For example diseases such as cancer and AIDS induce a body wasting syndrome called "cachexia", which is notable for the severe muscle atrophy seen. Other syndromes or conditions which can induce skeletal muscle atrophy are congestive heart failure and liver disease.

During aging, there is a gradual decrease in the ability to maintain skeletal muscle function and mass. This condition is called "sarcopenia", and may be distinct from atrophy in its pathophysiology. While the exact cause of sarcopenia is unknown, it may be induced by a combination of a gradual failure in the "satellite cells" which help to regenerate skeletal muscle fibers, and a decrease in sensitivity to or the availability of critical secreted growth factors which are necessary to maintain muscle mass and satellite cell survival.[1]

Dyslexia and PTSD

The interview evidence suggests that many dyslexics go into child mode whenever they are around teachers, as one noted that it was as if the last twenty years had never happened, they transformed back to a child even though they were an adult with a degree. Even Lara who teaches in schools, feels a little girl again, withdrawn and in detention whenever she needs to sit outside the headmasters office before meetings and she has been teaching for years in various schools. As Rachel notes she has these same belittling feelings with doctors and another medical staff, a feeling of not being worthy and that others are more intelligent than she is.

‘Post-traumatic stress disorder’ (PTSD) in dyslexics can come from various factors, these include: the sudden exclusion from their peer group; intense anger from a teacher or parent, physical bullying at school; realisation that something unrecognisable is wrong (maybe realising that they are not normal or do not learn normally, being called stupid, lazy etc). There are two forms of PTSD, which Scott (2004) suggest dyslexics suffer. The first is Type 1 (an acute, single-impact traumatic event) and Type 2 or complex PTSD (a series of traumatic events or prolonged exposure to a stress or stressor), both are listed in the DSM-IV (APA, 1994). PTSD is a widely researched aspect of psychology (see Rose, 2002; Stallard, Karwit and Wasik, 1999 for reviews). PTSD is categorised by being the sudden and irrevocable perceptive change of the world from one that is safe and predictable to one that is dangerous and random. Individuals are as traumatised as if they had been in a major car crash. The behavioural effects of PTSD come from repetitive and intrusive thoughts and can be triggered by vision, sound and smell (as noted by Miles and Varma, 1995; Riddick et al, 1999). Yule, Bolton, Udwin, Boyle, O’Ryan and Nurrish (2000) found only 25% of PTSD sufferers had recovered after five years, 33% after eight years and 59% warranted a lifetime diagnosis.

English is hard on dyslexics

In English, many words share the same letter combinations, but involve different sounds when spoken. For example: mint and pint; cough and bough, and clove and love. In French, the complexity stems from different letter combinations that "spell" the same or similar sound, such as "au temps" (at the time) and "autant" (as much, or so much).

Frith said that Spanish, Finnish and Czech are "dyslexia friendly" languages because they lack the sound-spelling complexity of English and French. Japanese, he said, is also easier for children learning to read because of its consistency of sounds and symbols.

"One study found an Australian boy in Japan who was dyslexic in English, but not in Japanese," said Frith. "That is the sort of thing that you would expect" if language was a significant factor in the severity of the reading disorder.

Study brains hippocampus shrinks due to depression

Study: Brain's Hippocampus Shrinks Due to Stress in Children

Psychiatrists know post-traumatic stress disorder, or PTSD, develops in people exposed to chronic stress. Researchers have studied the brains of adults with the psychological disorder and found a region of their brains called the hippocampus to be smaller than in people without PTSD. The hippocampus is a part of the brain associated with the storage and retrieval of memories.

Dr. Victor Carrion, a psychiatrist at California's Stanford University wondered if the same phenomenon occurred in children, and if exposure to severe stress caused their hippocampi to shrink.

Carrion and his colleagues evaluated 15 pre-adolescent children with symptoms of PTSD, including nightmares and uncontrollable flashbacks, extreme agitation and emotional numbness. They assessed the children's behavior at the beginning of the study and again after 12 to 18 months. They also measured blood levels of the stress hormone cortisol and took images of their brains.

They found that kids with more severe PTSD symptoms had more cortisol in their blood and their hippocampi decreased in volume. "What that means is that the higher your symptoms of PTSD, or the higher your level of cortisol, the higher your chances of having a decrease in the size of this structure," Carrion notes, adding that this was the first time researchers have really seen that connection, indicating how cortisol might be related to the hippocampus.

Carrion says he was surprised at how quickly the changes occurred, even though the children were not experiencing trauma during the time of the study. "This is a trauma that they experienced in the past," he explains, "so we're seeing the consequences of the trauma having an effect on the individual, not only the trauma."

Carrion says knowing about the physiologic changes in the hippocampus might help researchers understand why PTSD becomes a chronic condition and develop better treatments to help children. His study appears in the journal Pediatrics.

While the study was done on children, it most likely has bearing on adults as well. It also may the first step to clearing up one debate in the field. Jake Young at Pure Pedantry explains:

There was a debate in the post-traumatic stress disorder (PTSD) for some time about whether the shrinkage observed in the hippocampus -- a structure involved in learning and memory -- was the result of the stress or was a vulnerability factor for the disease.

We know that high levels of cortisol -- a stress hormone -- can kill neurons. So you could argue that the stress and stress hormones that cause PTSD could also result in the reduction in hippocampal volume. This is the so-called neurotoxicity hypothesis.

On the other hand, individuals who get PTSD could have some underlying genetic or structural susceptibility, one characteristic of which could be an already smaller hippocampus. This is the so-called vulnerability hypothesis.

He goes on to say that the Stanford study "adds credibility to the neurotoxicity hypothesis."

There have been studies showing a change in brain activity when mood shifts, but there is now also research showing a change in brain shape that appears to be associated with severe mood disorders. The brain shrinks, or rather, certain parts of it do. One of those parts is called the hippocampus. This part is associated with making and being able to recall memories. If mood symptoms are severe or go on very long, the hippocampus shrinks. This chapter shows you the evidence that this shrinkage really occurs. The same process appears also to be occurring in frontal lobes as well, though not elsewhere in the brain. This brain shrinkage, called "atrophy", has long been associated with Alzheimer's dementia; but lately it has also been associated with obesity, and even with back pain -- perhaps through some common mechanism with depression?

Hopelessness

Depression described
Anger turned inward Psychoanalysts have long believed that anger towards others gets turned against ourselves. Our anger converted into self-hatred causes depression. Karen Horney (see Monte, 1980, or any theories of personality book) wrote that the basic problem starts with neurotic parents who are inconsistent (both overindulgent and demanding), lacking in warmth, inconsiderate or openly hostile, or driven by their own needs. The child resents these things. But parents are powerful and a child's only means of survival. So, because of fear or love or guilt, the child represses the anger. The child, being small, alone, confused, and helpless in an unpredictable, hostile world, is, of course, scared. How does the child protect itself? The child, aware of his or her weakness, the criticism of others, and his or her own hostility and fears, develops a "despised" self-concept. Also, the resentment of others has been turned against the self: "I am unlovable, a bad person." At the same time, the child starts to develop a notion of an "ideal" self--what he/she should be--in order to survive and get the love and approval he/she wants. This ideal self, trying to compensate for weakness and guilt, sets up impossible demands, called neurotic needs. These needs are unconscious, intense, insatiable, anxiety-causing, and out of touch with reality. For instance, if one has a neurotic need for affection, it becomes urgent to be loved by everyone, all one's peers, all the family, teachers, the paper carrier, etc. Horney listed several neurotic needs, primarily needs for perfection, power, independence, and affection. All are attempts to handle the primitive hostility from childhood. So, how do we get depressed? In extreme cases, some people become so self-effacing, i.e. compliant, unselfish, and modest; they almost do away with their "self." Suffering, helplessness, and martyrdom are their ideals. They need to be loved, liked, approved, important, but taken care of. Their "solution" is: "If you love me, you will not hurt me." But beneath this saintly, goody-goody surface sometimes boils the old anger, rage, and strong urges to be aggressive and mean. Besides, love never runs smoothly--remember everyone must love them--so these kinds of dejected people may turn against themselves, becoming very self-critical and unhappy. Often they have also become bitter because the unwritten agreement was broken, namely, "I'll be nice and not hate you, if you will love, respect, and care for me always." People striving for sainthood often suffer because others will not always put them first.

Depression is anger turned inward

Equally surprising, the DSM fails to list anger as a symptom for either depression or mania, perhaps because the trait is endemic in the general population, as well, and so is regarded as normal (which is a very scary thought). Make no mistake - any state of mind that can disrupt your work and social relationships and potentially freeze you out of any life worth living should not be regarded as normal.
